PIAB is an Independent State Body which has been tasked with assessment of personal injury compensation in Ireland. Accident claims such as motor accidents, work place accidents and public place accidents have to be lodged to the Injuries Board for assessment. Once lodged PIAB will notify the party that is at fault and they will need to decide if they wish to consent or decline the assessment by PIAB.

STEP BY STEP GUIDE TO PIAB

  • Call Houlihan Solicitors to discuss your case.

  • We will obtain a medical report from your doctor.

  • We will lodge your application to PIAB.

  • PIAB will notify the Respondent (person or company you are claiming against) of a new claim.

  • We will await a response from the Respondent.   The Respondent will either consent or decline the assessment of the application.

  • Attend independent medical examination arranged by PIAB (if Respondent consents ).

  • Submit your medical receipts to us for inclusion in the assessment of compensation.

  • Advise us if you have suffered any loss of income as a result of the accident.
  • PIAB make an assessment (monetary value of your claim based on the injuries sustained).
  • You can accept or reject the assessment.

  • If you accept, a settlement cheque will issue to you.

  • If you reject, personal injury court proceedings are issued on your behalf.

We recommend that you review the new PI Guidelines approved by the Judicial Council on the 24th of April 2021  Click HERE

The new guidelines will change the amounts recoverable as General Damages Compensation. The new rules will reduce the overall levels of awards in Ireland and bring them into line with awards in other countries.  The Injuries Board will apply the new guidelines to every claim that is lodged with them.   We will ensure that all of your injuries are specified on the application so that nothing is missed.   We will go the extra mile to ensure that your award is fair and proportionate to your injuries.  We have a lot of experience in dealing with different types of injuries and we will make sure nothing is missed.

We operate on a “no win, no fee basis” as explained HERE. Our PIAB solicitor-client fee is a set fee that will be notified to you in writing at the very start of your case and we can guarantee that it will not change during the process.   We do not increase our fee depending on the level of award made i.e. whether your assessment is €10,000 or €100,000.

There is a small charge for lodging an application with the Injuries Board.   The fee for a paper application is €90.00 and online form is €45.00.  We will also need a medical report to accompany your application.  The medical report is requested from your treating doctor and they cost between €200 and €400.  This fee is set by your GP or treating doctor.

How long will the PIAB process take?2021-10-30T15:13:33+00:00

If the Respondent consents to the assessment of the claim, the process can take between 9 to 12 months.  During this time, PIAB will arrange an independent medical examination for you which you will need to attend.
